PitchWall reserve the right, at any time, to amend, modify, add, alter, update or make corrections to the terms and conditions of this Agreement, but if we do, we will bring it to your attention by placing a notice on the PitchWall.co website, by sending you an email, or by some other means. The most current version of the Agreement will supersede all earlier versions and can be accessed through PitchWall.co The use of PitchWall constitutes an acknowledgment and acceptance of the most recent version of the Agreement.
In order to use the Services, you will be required to register with PitchWall. You must provide all information as requested by PitchWall in the registration/signup process, and you represent and warrant that all such information shall be accurate and complete. You shall keep such information up-to-date. You may not transfer your account to anyone else without our prior written permission.
You will only use the Services for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the Services is prohibited by applicable laws, then you aren’t authorized to use the Services. We can’t and won’t be responsible for your using the Services in a way that breaks the law.
You will not share your account or password with anyone, and you must protect the security of your account and your password. You’re responsible for any activity associated with your account.
You represent and warrant that your startup listing.
- Does not infringe the intellectual property rights of any third party,
- Does not contain any defamatory, libelous, obscene or otherwise offensive material,
- complies with all applicable law and regulations,
- Does not contain any worms, viruses, spyware, adware or other malicious or intrusive software. If the listing does not match with any of the above criteria, then PitchWall reserve the sole right to edit/update or delete any such submission and block the associated user account.
Your use of the Services is subject to the following additional restrictions
- Jeopardizes the security of your PitchWall account or anyone else’s
- Attempts, in any manner, to obtain the password, account, or other security information from any other user;
- Violates the security of any computer network, or cracks any passwords or security encryption codes;
- Runs Maillist, Listserv, any form of auto-responder or “spam” on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services.
- “Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or Content (through use of manual or automated means);
- Copies or stores any significant portion of the Content;
- Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services.
A violation of any of the foregoing is grounds for termination of your right to use or access the Services.
The content available on PitchWall including, but not limited to, text, graphics, data, articles, photos, images, illustrations, User Submissions, and so forth (all of the foregoing, the “Content”) are protected by copyright and/or other intellectual property laws. You promise to abide by all copyright notices, trademark rules, information, and restrictions contained in any Content you access through the Services, and you won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you, (i) without the prior consent of the owner of that Content or (ii) in a way that violates someone else’s rights.
You understand that PitchWall owns the Services. You won’t modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Section), create derivative works based on, or otherwise exploit any of the Services.
Who is responsible for what I see and do on the Services?
Any information or content publicly posted or privately transmitted through the Services is the sole responsibility of the person from whom such content originated, and you access all such information and content at your own risk, and we aren’t liable for any errors or omissions in that information or content or for any damages or loss you might suffer in connection with it. We cannot control and have no duty to take any action regarding how you may interpret and use the Content or what actions you may take as a result of having been exposed to the Content, and you hereby release us from all liability for you having acquired or not acquired Content through the Services. We can’t guarantee the identity of any users with whom you interact in using the Services and are not responsible for which users gain access to the Services.
You are responsible for all Content you contribute, in any manner, to the Services, and you represent and warrant you have all rights necessary to do so, in the manner in which you contribute it. You will keep all your registration information accurate and current. You are responsible for all your activity in connection with the Services.
PitchWall has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or by any third party that you interact with through the Services. In addition, PitchWall will not and cannot monitor, verify, censor or edit the content of any third party site or service. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third party website or service.
If there is a dispute between participants on this site, or between users and any third party, you agree that PitchWall is under no obligation to become involved. In the event that you have a dispute with one or more other users, you release PitchWall, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.
PitchWall does not guarantee the Services/website will be operable at all times or during any down time (a) caused by outages to any public Internet backbones, networks or servers, (b) for previously scheduled maintenance or © relating to events beyond PitchWall’s control such as strikes, riots, insurrection, fires, floods, explosions, war, governmental action, labor conditions, earthquakes, natural disasters, or interruptions in Internet services to an area where PitchWall’s servers are located.
Limitation of liability
To the fullest extent allowed by applicable law, under no circumstances and under no legal theory (including, without limitation, tort, contract, strict liability, or otherwise) shall PitchWall (or its licensors or suppliers) be liable to you or to any other person for (a) any indirect, special, incidental, or consequential damages of any kind, including damages for lost profits, loss of goodwill, work stoppage, accuracy of results, or computer failure or malfunction, or (b) any amount, in the aggregate, in excess of the greater of the amounts paid by you to PitchWall in connection with the services in the twelve (12) month period preceding this applicable claim, or any matter beyond our reasonable control.
You hereby release and agree to hold harmless PitchWall, its parents, Directors, subsidiaries, affiliates, officers, managers and employees, officers, attorneys, agents, licenses and assigns and each of their respective designees with respect to any claim or demand, damages, costs, losses and expenses, including reasonable attorneys’ fees and costs made by any third party due to or arising out of your use of the Services, and/or the breach of this Agreement, or infringement by User, or other user of the Service using the Members’ computer, of any intellectual property or any other right of any person or entity.

These Terms shall be governed by the laws of the India, and the competent courts in the city of Indore, Madhya Pradesh shall have exclusive jurisdiction to hear any disputes arising hereunder.
As a user, you agree to use the Services and Site only for lawful purposes. You may not use the service to transmit any material that in any way violates applicable state, federal or international laws, regulations or other government requirements.
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall be enforced. You may not assign or transfer any of your rights or obligations under this Agreement. PitchWall’s failure to act with respect to a breach by you or others does not waive PitchWall’s right to act with respect to subsequent or similar breaches.
PitchWall does not guarantee it will take action against all breaches of the provisions of this Agreement. This Agreement set forth the entire understanding and agreement between you and PitchWall with respect to is subject matter.
PitchWall may terminate your use of this Site or the Services at any time for any reason which seems appropriate, with or without notice. This Agreement shall continue to govern all use of this Site and the Services notwithstanding any termination, suspension or cancellation.
